Intellectual Property
Intellectual Property
1. Introduction
NERS Jurnal Keperawatan (NJK), published by the Faculty of Nursing, Universitas Andalas, is committed to the responsible dissemination of scholarly research in nursing and health sciences. This policy outlines the principles governing intellectual property, copyright ownership, licensing, author rights, permissions for third-party materials, and the ethical use of published work.
NJK supports open access to scholarly knowledge while respecting the intellectual property rights of authors, researchers, institutions, and other rights holders. The journal aims to ensure that authors and readers understand the terms under which published articles may be shared, reused, and adapted.
NJK's intellectual property policy is intended to promote responsible scholarly communication, proper attribution, originality, and compliance with applicable copyright and publication ethics requirements.
2. Description
Intellectual Property: Refers to creations of the mind, including scholarly articles, research instruments, photographs, illustrations, tables, figures, and other materials protected by applicable intellectual property laws.
Copyright: Refers to the legal rights associated with an original work, including the rights to reproduce, distribute, display, and adapt the work, subject to applicable law and licensing terms.
Open Access: Means that published articles are freely accessible online without subscription charges. The reuse of articles is governed by the applicable license and relevant legal requirements.
Creative Commons License: A standardized license that specifies how others may use, share, or adapt a work. NJK uses the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International License (CC BY-NC-SA 4.0), as stated in its publication policies.
Plagiarism: Refers to presenting another person's words, ideas, data, or work without appropriate acknowledgment. Plagiarism is a serious breach of academic integrity and may also infringe intellectual property rights.
Redundant or Overlapping Publication: Refers to the inappropriate publication of substantially overlapping work without proper disclosure, acknowledgment, or justification.
Prepublication: Refers to the dissemination of research findings before formal journal publication, including through preprint servers, conference abstracts, proceedings, theses, dissertations, or institutional repositories. Whether prior dissemination affects a manuscript's eligibility for consideration is governed by NJK's applicable submission and author guidelines.
Third-Party Materials: Refers to materials created or owned by parties other than the manuscript's authors, including photographs, figures, tables, questionnaires, scales, illustrations, and substantial text excerpts.
3. Policy
3.1 Copyright Ownership
Authors retain copyright of their articles published in NJK, subject to the journal's applicable publishing terms and agreements.
Authors are responsible for ensuring that they have the necessary rights and authority to submit and publish the manuscript, including the rights to any material contributed by co-authors or reproduced from third-party sources.
Publication in NJK does not remove the obligation to acknowledge the original creators of material used in the manuscript.
3.2 Publishing License
Articles published in NJK are distributed under the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International License (CC BY-NC-SA 4.0).
Under this license, users may share and adapt published material for non-commercial purposes, provided that they:
-
Give appropriate credit to the original author(s) and identify the original publication in NJK.
-
Provide a link to the applicable Creative Commons license.
-
Indicate whether changes have been made to the original material.
-
Distribute adaptations under the same license when required by the CC BY-NC-SA 4.0 terms.
-
Do not use the material for commercial purposes under this license.
The full license is available at:

Users must comply with the license terms and any other applicable legal requirements when reusing NJK articles.
3.3 Authors' Rights and Responsibilities
Authors retain the rights provided under the applicable copyright law and the CC BY-NC-SA 4.0 license.
Authors may share and reuse their published articles in accordance with the license terms, including through personal websites, institutional repositories, academic profiles, and subsequent scholarly work, provided that the original publication is properly acknowledged.
Authors must ensure that submitted manuscripts are original, that all sources are appropriately cited, and that the use of third-party materials complies with applicable copyright and licensing requirements.
Authors are also responsible for ensuring that the manuscript does not unlawfully disclose confidential information or infringe the rights of patients, research participants, institutions, or other parties.
3.4 Permissions for Third-Party Materials
Authors must obtain permission from the relevant copyright holder when permission is required to reproduce or adapt third-party materials in a manuscript.
Such materials may include photographs, figures, tables, illustrations, questionnaires, measurement scales, clinical images, and substantial text excerpts.
Authors should verify the license and reuse conditions of any material obtained from external publications, websites, repositories, or other sources. Proper citation alone does not necessarily constitute permission to reproduce copyrighted material.
Where applicable, authors must provide evidence of permission and include the required acknowledgment or credit line in the manuscript.
For materials involving patients or other identifiable individuals, authors must also comply with NJK's Ethical Oversight policy and obtain the required consent for publication.
3.5 Plagiarism and Redundant Publication
NJK expects all submitted manuscripts to demonstrate originality and appropriate acknowledgment of previous work.
Plagiarism, inappropriate text recycling, data appropriation, and redundant or duplicate publication are unacceptable. Authors must cite sources accurately and disclose any relevant prior publication or dissemination of the submitted work.
NJK may use plagiarism detection or other screening tools to assess manuscript originality. Where potential plagiarism or substantial overlap is identified, the journal may request an explanation, conduct further assessment, or take appropriate editorial action in accordance with its Allegations of Misconduct policy.
Possible actions include rejection of the manuscript or, where concerns arise after publication, correction, an Expression of Concern, or retraction, depending on the circumstances and available evidence.
3.6 Prepublication and Prior Dissemination
Authors must disclose relevant prior dissemination of their manuscript or closely related work when submitting to NJK.
The eligibility of manuscripts previously shared as preprints, conference abstracts, proceedings, theses, dissertations, or institutional publications is determined by NJK's applicable Author Guidelines and submission policies.
Authors should provide the relevant citation or persistent link to previously disseminated versions where applicable. Prior dissemination must not be concealed if disclosure is required by the journal.
Submission of a manuscript to NJK must also comply with the journal's requirements concerning simultaneous submission and prior publication.
3.7 Copyright of Peer Review Reports
Peer review reports may contain original intellectual contributions by reviewers. Their use, disclosure, or publication must respect reviewer confidentiality, applicable copyright rules, and NJK's peer review policy.
NJK will not assume that peer review reports may be publicly reproduced or redistributed without an appropriate basis or permission. Any disclosure of review reports must follow the journal's applicable peer review arrangements and confidentiality requirements.
3.8 Publication Costs
Any article processing charges, submission fees, or other publication-related costs applicable to NJK must be stated transparently on the journal's official website.
The existence, amount, timing, and applicable conditions of any publication fee are governed by NJK's current publication fee policy. Authors should consult the journal website for the most current information.
Publication fees, where applicable, do not confer ownership of copyright and do not change the licensing terms of published articles.
3.9 Journal Name and Branding
The name NERS Jurnal Keperawatan (NJK), its logo, and other journal-specific branding elements are associated with the journal and its publisher, the Faculty of Nursing, Universitas Andalas.
Use of these branding elements must not falsely imply endorsement, affiliation, or authorization by the journal or publisher. Any use beyond ordinary scholarly citation or other legally permitted purposes must comply with applicable law and any relevant authorization requirements.
4. Technical Requirements and Implementation
4.1 Copyright and License Statements
NJK's website and published articles should clearly identify the applicable copyright and licensing terms.
Where appropriate, the article landing page and full-text version should display the CC BY-NC-SA 4.0 license statement and provide a link to the full license text.
The journal's copyright and licensing statements must be consistent with the terms accepted by authors and the licensing information displayed on the official website.
4.2 Author Publishing Agreement
At the relevant stage of the publication process, authors may be required to confirm that they have the authority to submit the manuscript, that the work is original or properly attributed, and that they agree to the journal's applicable copyright and licensing terms.
Any publishing agreement or author declaration used by NJK must accurately reflect the journal's stated policy and must not contradict the authors' copyright ownership or the applicable Creative Commons license.
4.3 Permission Documentation
When permission is required for third-party material, authors must obtain it before publication and provide evidence when requested by the journal.
Authors should retain permission records and ensure that any required attribution, license information, or restrictions are included in the manuscript.
If the necessary rights or permissions cannot be established, the journal may require the material to be removed, replaced, or revised before publication.
4.4 Screening and Handling Intellectual Property Concerns
NJK may assess suspected plagiarism, unauthorized reproduction, redundant publication, or other intellectual property concerns during editorial review or after publication.
Such concerns will be handled in accordance with the journal's Allegations of Misconduct policy and relevant publication ethics guidance.
Authors may be asked to provide explanations, original sources, permissions, or other relevant documentation. Editorial decisions will take into account the nature of the concern and the available evidence.
4.5 Author Self-Archiving and Sharing
Authors may share their published articles in accordance with the CC BY-NC-SA 4.0 license and applicable journal policies.
When depositing or sharing an article, authors should include the complete citation of the published version, the journal name, and a link to the official article page or DOI, if available.
Authors should ensure that any shared version retains the appropriate copyright and license information and that reuse complies with the applicable license terms.
4.6 Open Access and Accessibility
NJK supports the dissemination of scholarly knowledge through open access. Published articles are made available through the journal's official website under the applicable licensing terms.
Users may access and reuse published content within the scope of the stated license. Open access does not remove the obligation to provide appropriate attribution, respect non-commercial use restrictions, or comply with applicable copyright and privacy requirements.
5. Policy Review
NJK may periodically review this policy to ensure consistency with developments in copyright law, open access publishing, intellectual property protection, and publication ethics.
Authors are encouraged to review the journal's current Author Guidelines, publication ethics policies, and licensing information before submitting a manuscript.
